Plain Language Section

The Brandow Company cannot be responsible for accidental deletions, omissions or erasures of profile information created by any registered user.

When you purchase or aquire a Profile, it is for your confidential use or for re-sale to one client or customer. You cannot publish the Profile or the information in it except for use in your own confidential planning documents, such as a business plan or loan application. You may resell the Profile or the information in it to one other person or entity with two stipulations: 1) after you do, it’s not yours to use anymore; and 2) the recipient must agree not to sell or distribute the information except for use in their own confidential planning documents, such as a business plan or loan application.

In Formal Language

The Brandow Company, Inc. grants a non-exclusive limited license to the Purchaser (you or the business entity purchasing the Profile) to use the data, whether transmitted electronically, on CD-ROM, diskette or hard copy, or on discs, under the terms and conditions set forth below:

Allowable use:
-The Purchaser may use a purchased Profile for internal personal or business purposes. The Purchaser may also sell or distribute any purchased Profile or the information contained in it one time to a single entity, including one customer or client, either as a discrete product or as part of a value added bundle of products, services or information. This license extends to a single such sale or distribution. By reselling or distributing any Profile or information from any Profile under this license, the original Purchaser foregoes rights to any future use of the Profile or information contained in it. This license does not extend to distributing or reselling the Profile or information in any Profile to multiple other entities without the express written permission of the Brandow Company Inc. No other print copies or electronic copies are permitted, nor is the information contained therein to be disseminated or distributed publicly or in any manner inconsistent with the proprietary rights of the Brandow Company Inc. Any recipient of the Profiles or of any information contained in the Profiles from the Purchaser is considered the end user. Purchasers who resell or otherwise distribute the Profile or information contained in the Profile will give the recipient a copy of this statement, and the recipient must agree to the restrictions contained herein before the Purchaser resells or distributes any Profile.

-The Purchaser may not:
-Create more than one electronic copy of any Profile.
-Copy, transfer or apply data from reports to any public document, or any document not intended for use by the Purchaser or by clients or customers of the Purchaser except as described above.
-Directly or indirectly sell or disclose reports contained in the Profiles to third parties, except to clients or customers as described above.

The Brandow Company Inc. retains all rights not expressly granted. Nothing in this Agreement constitutes a waiver of the rights of the Brandow Company, Inc. under the U.S. copyright laws or any other federal or state laws.

Neither the Brandow Company nor its resellers has undertaken independent primary research to confirm the accuracy of the data utilized in the Profile analyses. Neither the Brandow Company nor its resellers are responsible for conclusions drawn or decisions made based upon this data or analysis. In no event will the Brandow Company or its resellers be liable for any damages, direct, indirect, incidental or consequential resulting from the use of the information contained in BizMiner reports.

The data utilized in the Profiles is collected by the nation's most acknowledged business reporting agencies, and is regularly updated. As a result, the Profiles are presented with a high degree of confidence. Profiles are not based on historical computer models or projections -- they are developed from financial and informational reports from literally millions of individual firms.

At the same time, private sector firms are not legally required to supply information to private reporting services. As a result, some firms and specific information on others is lacking from the database. However, the overall current coverage of the databases approaches 12 million firms annually and approximately 15 million firms are tracked for the creation of the Profiles over a three-year period. While 100% firm coverage is desirable for analysis purposes, the greatest value of the Profiles rests in discerning patterns of activity, which are reflected in the large samples used to develop the Profiles.

As is the case with any databases this large, some errors are inevitable. No representation is made as to the accuracy of the databases utilized or the results of subsequent analyses. Survival and sales analysis of franchisees and independent business operations are based on information supplied largely by business owners and representatives to private credit reporting services. Inaccurate information supplied by franchisees or other business owners or representatives may affect the analysis. Survival rates assume that the discontinuation of a facility's presence among the credit reporting databases reflects the discontinuation of operations of that facility. The Brandow Company has undertaken no independent primary research to confirm the accuracy of the data utilized in the Profile analyses. The Brandow Company is not responsible for conclusions drawn or decisions made based upon this data or analysis. In no event will the Brandow Company be liable for any damages, direct, indirect, incidental or consequential resulting from the use of the information contained in this profile.

The warranty and remedies set forth above are exclusive and in lieu of all others, oral or written, express or implied, including without limitation the implied warranties fitness for a particular purpose

Privacy Policy

We will not sell or distribute registration or purchasing information from any user who has independently arrived at www.bizminer.com or www.brandow.com.

We will not sell or distribute information about your firm that you place in a BizMiner benchmarking Profile.

We may provide contact information to affiliates regarding users who have linked from that affiliate site. We do not provide such information to all affiliates, and never provide any such information about users who have not linked from the affiliate site in question.

Refund Policy

Our products are intellectual property. We do not extend refunds or credits for purchases. Where there is a reasonable question as to the accuracy of statistics we present, we will make a reasonable effort to check the underlying data and assure that we have reported or manipulated it accurately.

Limitations regarding various report series and industry classifications are clarified on our web site, especially through the free sample reports which are accessible throughout the selection and purchasing process. A report purchased for any industry or area will include exactly the same measures and format as the sample of that series or version.

When you purchase an online report, you will be taken to an account page which has been established for you. You can access your report(s) from that page by selecting the corresponding icon(s). In addition, we will send you an email with login information for unlimited future access to your report(s). We will utilize the email that you input prior to your transaction. It is your responsibility to input a valid email address, and to set your spam controls so that you can receive the information from us. If you did not provide a valid email address, or were unable to receive our email, we have still attempted to deliver both the report and access information to you. Additionally, you can call us (866-863-9853) or email us at any time if you have difficulty accessing your report(s) online. Since our systems provide all the information and assistance you need to access your report(s) within a reasonable period of time, we will not provide refunds for report(s) that you do not access with the information we send you, or with the follow-up assistance offered here.

Notwithstanding any of the above, any claim filed by purchasers or other customers shall be filed in the home county and state of the Brandow Company (Cumberland County, PA) and be governed by the laws of the Commonwealth of Pennsylvania to the extent that any claim shall be found to supersede the "no refund" and other policies stated herein. Any claims shall be subject to review under these Terms of Service. Claims filed under other jurisdictions shall be null and void.
